These Terms of Service (hereinafter "TOS") govern access to and use of the services provided by CreativeIT, a company registered in Dubai (United Arab Emirates) under registration number 2205038.01. By accessing the website creativeit-llc.com, using our SaaS applications for online service sales and e-commerce site creation, or requesting a custom application study, you fully accept these TOS.
Article 2 : Services Provided
2.1 SaaS Subscription
We offer e-commerce site creation and online service sales services in SaaS mode. Our applications are available via a monthly or yearly subscription, depending on the plan chosen by the user. These services include hosting, maintenance, updates, and access to a user-friendly interface.
2.2 Custom Application Studies
In addition to the standard SaaS solutions, we offer the option to request a study for the creation of a custom application. This study is a specific service, separate from the SaaS subscription, and requires a personalized quote before the start of the work.
Article 3 : Subscription Terms
3.1 Subscription Terms
The subscription to our SaaS services is subject to the selection of the appropriate subscription plan by the user. You will be able to choose from different subscription levels depending on the features required for your project.
3.2 Duration and Termination
Subscriptions are automatically renewed at the end of each period, unless terminated by the user. The user may cancel their subscription at any time before the end of the current period, but no refunds will be made for already paid periods.
3.3 Pricing
Subscription prices are listed on our website. They may be revised periodically, with or without prior notice. Pricing for a custom application study is communicated after a prior consultation with our teams.
3.4 Free Trial
We may offer limited-time free trials for certain services. The user will be informed of the free trial period and the automatic conversion to a paid subscription at the end of this period.
Article 4 : Use of Services
4.1 Access to Service
The user agrees to use our services in accordance with their intended purpose and to comply with all applicable laws in the country where they reside. Access to the services is protected by a username and password, which the user must keep confidential.
4.2 User Responsibility
The user is responsible for the integrity and security of their account. They must immediately notify CreativeIT of any unauthorized access to their account.
4.3 Use of the Application
The user agrees not to use our services for illegal or harmful activities, such as hacking, fraud, or the distribution of illegal content (alcohol, meats, drugs, medicines, medical care, lottery, financial services, counterfeit products, pornography, prostitution...).
Article 5 : Intellectual Property
5.1 Ownership of Applications and Content
All intellectual property rights related to the applications, user interfaces, technologies, and content are the exclusive property of CreativeIT. The user is granted a non-exclusive, non-transferable right to use them for the duration of their subscription.
5.2 User Content
The user retains all rights to the content they upload or create using our services. However, by using our services, the user grants CreativeIT a worldwide, free, non-exclusive license to host, store, and process this content in connection with the provision of our services.
Article 6 : Confidentiality and Security
6.1 Data Collection
We collect and process personal data in accordance with our Privacy Policy. This data is used to provide and improve our services. The user agrees to provide accurate and up-to-date information during registration.
6.2 Data Security
We implement reasonable technical and organizational measures to ensure the security of user data. However, we cannot guarantee absolute security on the internet and disclaim any liability in case of data breaches.
Article 7 : Limitation of Liability
7.1 CreativeIT's Liability
CreativeIT strives to provide quality services but cannot be held responsible for interruptions, errors, or data losses that may occur during the use of our services, except in cases of gross negligence or intentional misconduct.
7.2 User's Liability
The user is responsible for using our services and complying with local laws. We cannot be held liable for the consequences of misuse of our services.
Article 8 : Changes to the TOS
CreativeIT reserves the right to modify these TOS at any time. Any changes will be notified to the user via email or through a message on our site. The user is responsible for regularly checking the TOS to stay informed of any updates.
Article 9 : Governing Law and Jurisdiction
These TOS are governed by the laws of the United Arab Emirates. In case of a dispute, the courts of Dubai will have exclusive jurisdiction.
